The return of the wobbly carrot!
From 1 July 2009, EC Regulation 1580/07 (as amended by EC Regulation 1221/2008) provides for the removal of Horticultural Marketing Inspectorate (HMI) conformity certificate controls on a range of fruit and vegetables at import.
What is the present situation?
At present, most fruit and vegetables imported from third countries are subject to marketing standards. They must either be accompanied on importation by an HMI certificate of conformity or be inspected by the HMI with the aim of gaining the conformity certificate, without which, HM Revenue & Customs are legally obliged to withhold the release of the goods into free circulation.
What is changing?
The table is the Annex from the said regulation and shows which products are affected by these changes. However, it must be noted that all other products that were subject to HMI conformity certificates will continue to be subject to Specific Marketing Standards (SMS) controls.
These fruit and vegetable products currently require prior notification and a conformity certificate but now will not require notification or a certificate.

Furthermore, as well as relaxing controls for conformity certificates on a range of fruit and vegetable products, the EC Regulation in question now states that all fruit and vegetables that are imported for processing will not require a processing certificate issued by HMI. Instead, importers are to fill in Document Code "C633" in Box 44 of the CHIEF declaration and Document Status Code "XW" in the same declaration to indicate that a waiver to produce a document has been claimed.
