Commission Regulation amending the time-limit for the issuing of AEO certificates by Customs

Commission Regulation No. 197/2010 has amended the time-limit that Customs Authorities are obliged to issue an AEO certificate within.

Article 14o(2) of the Customs Code Implementing Regulation (CCIP) (Commission Regulation 2454/93/EEC) provided that an AEO application should be processed (or rejected) and a certificate issued within 90 calendar days of the application with the possibility of extending the period for a further 30 days if the customs authority was unable to process the application in time.

However, in practice, the time period for processing was extremely optimistic and in most cases the application process went far beyond the time-period stipulated. As such, this time-period has now been extended by Commission Regulation 197/2010. Article 1 of the new regulation replaces the former article with:

"The customs authority shall issue an AEO Certificate or reject the application within 120 calendar days of the date of receipt of the application in accordance with Article 14c. Where it is unable to meet the deadline, this period may be extended by one further period of 60 calendar days. In such cases, the customs authority shall, before the expiry of the 120 calendar days, inform the applicant of the reasons for the extension."

The new provision has been enacted so that it applies retrospectively from 1 January 2010 onwards.
