EU Takes UK to Court over £15m of Uncollected Customs Duties

The EU Commission is taking the UK Government to the European Court of Justice for its failure to collect the full amount of customs duties on imports or fresh garlic from China which were incorrectly entered as frozen garlic.

HM Revenue & Customs keeps 25% of customs duties it collects and has to pay over 75% to the EU Commission. Customs duties makes up 15% of the EU budget. The EU Commission is obliged to take action against any Member State to protect the common EU interest and ensure that the regulations are applied consistently across all members.

This type of action underlines why HMRC will always seek to pursue any customs duties they believe to be legally due and why they do not settle cases, as doing so would leave the UK exchequer exposed.
