HM Revenue & Customs keeps 25% of customs duties it collects and has to pay over 75% to the EU Commission. Customs duties makes up 15% of the EU budget. The EU Commission is obliged to take action against any Member State to protect the common EU interest and ensure that the regulations are applied consistently across all members.
This type of action underlines why HMRC will always seek to pursue any customs duties they believe to be legally due and why they do not settle cases, as doing so would leave the UK exchequer exposed.
